ZerothLogix Solutions Private Limited (“Company”, “we”, “our” or “us”) and its affiliates respect your privacy. The Company is the author, publisher and owner of the internet resource https://www.zerothlogix.com and other software which the Company owns, operates and manages (together referred to as “Websites”) on the world wide web as well as other software and applications provided by the Company, including but not limited to the mobile applications (referred to as “App”) or third-party platforms (together referred to as “Digital Platforms”).

The term “Services” means any and all the services offered by the Company including logistics and transportation services on the Digital Platforms or otherwise. The Company also provide the Services in partnership/ association with its aggregators, agents, affiliates, associates, representatives, subcontractors, third-party vendors or service providers or other third parties (together referred to as “Partners”).

The terms “User”, “Users”, “you”, “your”, “yours” jointly and severally refers to the user of the Services or Digital Platforms, or the third-party vendor/service provider in respect of the provision of the Services or Digital Platforms including customers, service recipients, third-party vendors, service providers, etc.

This privacy policy (“Privacy Policy”) explains how we collect, use, store, share, disclose, transfer and protect personal information about the Users of the Services or Digital Platforms. We created this Privacy Policy to demonstrate our commitment to the protection of your privacy and your personal information. Your use of, access to, or provision of any service in relation to, or otherwise being User of, the Services or Digital Platforms are subject to this Privacy Policy and our Terms of Use. Any capitalised term used but not defined in this Privacy Policy shall have the meaning attributed to it in our Terms of Use or under applicable laws.

By confirming that you are bound by this Privacy Policy (by the means provided on the Digital Platforms), or by accessing the Digital Platforms or using the Services provided by the Company or being the User in any manner whatsoever or by otherwise giving us your information or data, you agree to the content, practices and policies outlined in this Privacy Policy and you hereby consent and you agree to the collection, use, storing, sharing, disclosing, transferring and otherwise dealing of your information or data by the Company as described in this Privacy Policy or as per applicable laws.

If you do not agree with this Privacy Policy at any time, do not use any of the Services, access our Digital Platforms or be the User in any manner whatsoever or otherwise give us any of your information. If you give us any information on behalf of someone else (such as your child) or an entity, you represent that you are authorized by such individual or entity to accept this Privacy Policy on such individual’s or entity’s behalf.

This Privacy Policy is an electronic record between you and the Company under the Information Technology Act, 2000 together with the rules framed from time to time.

We reserve the right to change, modify, and or delete portions of the terms of this Privacy Policy, at our sole discretion, at any time.

Why is the Privacy Policy required?

This Privacy Policy is published in compliance with, inter alia, Section 43A of the Information Technology Act, 2000 (“Act”), Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “Rules”), and other applicable laws. This Privacy Policy states the following:

  • Type of information collected from the Users, including sensitive personal data or information;
  • Purpose, means and modes of usage of such information;
  • How and to whom we will disclose such information;
  • How we ensure data security and facilitate the secure transfer of information; and
  • Other information as required under the applicable laws.

Personal Information

We require certain information from you to cater to your needs and provide the Services or engaging with you in relation to the Services. At the time of accessing our Digital Platforms or using the Services or otherwise providing us your information, we may ask you to voluntarily provide us with certain information that identifies you personally or can be used to personally identify you. Subject to the generality of the above, the information collected by the Company directly or through our Digital Platforms or office and other premises or by any other means whatsoever may include (but is not limited to):

  • Contact data (such as your name, email address and phone number);
  • Demographic data (such as your gender, your date of birth, address and your pin code);
  • Data regarding your usage of the Services and history of the appointments and other transactions made by or with you through the use of our Services;

  • Driver Partner-specific data including vehicle documents, health/fitness certificates, call and SMS logs (with consent), and background verification reports;
  • Other information as may be required by us to provide the Services; and
  • Other information that you choose to provide to us.

The information collected by us may constitute ‘personal information’ or ‘sensitive personal data or information’ under the Rules.

Personal Information is defined as any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person.

Sensitive Personal Data and Information means such Personal Information which consist of information relating to:

  • password;
  • financial information such as Bank account or credit card or debit card or other payment instrument details;
  • physical, physiological and mental health condition;
  • sexual orientation;
  • medical records and history;
  • Biometric information;
  • any detail relating to the above clauses as provided to a body corporate for providing service;
  • any of the information received under above clauses by body corporate for processing, stored or processed under lawful contract or otherwise.

Provided, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as sensitive personal data or information for the purposes of these rules.

This Privacy Policy shall be construed as a letter, under and in compliance with the applicable laws, to the Users, regarding the purpose of usage before collection of such information and for such intent and purpose as may be required under applicable laws.

How your information is collected during our interactions

We may collect and process your information when you interact with us through any of the following ways:

  • purchasing or using our products or procuring or taking our Services, including your visits to our office and other premises or requests or orders placed with the Company directly or through Digital Platforms;
  • providing any services, including your visits to our office and other premises or requests with the Company directly or through Digital Platforms in relation to the Services or Digital Platforms;
  • Registering with the Company or creating an account on the Digital Platforms;
  • Participating in any scheme, competition or event that we may host;
  • Signing-up to receive marketing emails, including but not limited to, newsletters, offers and promotions;
  • Donating to our fundraising or community initiatives; or
  • Contacting us with respect to your orders, queries, feedback, grievances or otherwise.

Collection of information during your visits to our office and other premises and usage of Digital Platforms

When you visit our office and other premises, we may collect your information through various means, including but not limited to:

  • Banking and billing Information: We may collect the banking and billing information and signing the contracts and other documentation and performance of obligations thereunder.
  • Payment and account details: If your payment is made through any digital mode other than cash, such as the Unified Payments Interface (UPI), credit card or debit card, we may either directly or through third-party collect account and payment details including the card number, expiration date, account number, etc. to process your payment in accordance with applicable laws.
  • Surveillance: We may use closed-circuit television (CCTV) cameras within our office and other premises for security, fraud prevention, incident reporting and loss-prevention purposes. Entering our premises will automatically capture your images and videos, enabling us to identify you, if required.
  • Internet: Our office and other premises may provide you with access to their Wi-Fi. If you opt to connect your device to our office and other premises’ Wi-Fi system, we may receive access to information pertaining to your device, Internet Protocol (IP) address, internet speed indicator and its technical capabilities.
  • Feedback: Our office and other premises may provide you with feedback form to provide your feedback. If you opt to provide your feedback, we may receive access to information pertaining to you and your feedback.
  • Other Information: Other information as listed above.

When you access our Digital Platforms, we may collect your information through various means, including but not limited to:

  • Personal details such as name, phone number, email address, delivery address;
  • Services requested or procured by you;
  • Services provided by you;
  • Your requests, orders or transactions with the Company;
  • your payment and account information; and
  • other information as listed above.

This information is collected to enable us to tailor your experience and safety at our physical office and other premises and Digital Platforms. Please note that certain Services made available through our Digital Platforms have additional terms and conditions that may apply.

Acceptance of Terms of Use and Privacy Policy

A condition of each User’s use of and access to the Services or Digital Platforms or otherwise being the User is their acceptance of the Terms of Use and this Privacy Policy. Any User that does not agree with any provisions of the same has the option to immediately discontinue using the Services or accessing the Digital Platforms provided by the Company or stop being User.

All the information provided to us by a User, including sensitive personal information, is voluntary. You understand that the Company, either by itself or with its Partners, may use certain information of yours, which has been designated as ‘sensitive personal data or information’ under the Rules for the following purposes:

  • for the purpose of providing you the Services and Digital Platforms;
  • for the purpose of procuring services from you in relation to the Services or Digital Platforms;
  • for entering into contracts with you and performance of obligations thereunder;
  • for the research and development and upgradation of the Services and Digital Platforms;
  • for commercial purposes and in an aggregated or non-personally identifiable form for research, development, statistical analysis and business intelligence purposes;
  • for sale or transfer of such research, development, statistical or intelligence data in an aggregated or non-personally identifiable form to our Partners;
  • for internal recordkeeping;
  • contacting Users for offering new Services;
  • contacting Users for taking Services feedback;
  • processing job applications;
  • contacting users for quote or engagement with the Company;
  • to respond to any correspondence from our Users, to investigate complaints, queries, safety or security incidents;
  • to provide essential detection and prevention of fraud, theft and other criminal activities and to comply with our legal, regulatory and compliance obligations;
  • providing customer service to our Users; etc

You, as the User, hereby consent to such use of your information by the Company and its Partners. The collection of information which has been designated as ‘sensitive personal data or information’ under the Rules requires your express consent. By affirming your assent to this Privacy Policy, or by accessing the Digital Platforms, or by using the Services or being the User in any manner whatsoever or by otherwise giving us your information, you provide your consent as required under applicable law to our collection, use, storing, sharing, disclosing, transferring and otherwise dealing of your information as described in this Privacy Policy. Our Services/Digital Platforms may be unavailable to you in the event such consent is not given or withdrawn.

Users’ personally identifiable information, which they choose to provide on our Digital Platforms or in our office and other premises or otherwise, is used to for purposes including identity verification, account creation, service delivery, procuring services, contractual engagement, and personalizing User preferences. Other information that does not personally identify the Users as an individual such as usage patterns, interaction data, or general demographics, is collected by the Company or our Partners from Users (such as, patterns of utilization described above) and is exclusively owned by Company or its Partners. We or our Partners may also use such information in an aggregated or non-personally identifiable/ anonymised form for research, development, statistical analysis and business intelligence purposes, and may sell or otherwise transfer such research, development, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties.

In particular, we along with our Partners reserve with us the right to use anonymized User demographics information and anonymized User information for the following purposes,

  • Analysing software usage patterns for improving product design, utility, Services or User experience on Digital Platforms or in the office and other premises;
  • Analysing such information for research and development of new technologies and Services;
  • Using analysis of such information in other commercial product offerings of the Company or our Partners; and
  • Sharing the analysis of such information with third parties for commercial use.

Automated information collection

Apart from the information that you may provide to us directly, we along with our Partners, may collect certain additional information about your use of our Services or Digital Platforms. This information is used to facilitate the monitoring and analysis of the digital traffic within our Digital Platforms and user data related to Services availed by you, understand User preferences and to improve our Services and Digital Platforms. We may collect information including but not limited to:

  • Device information: To ensure a seamless experience on our Digital Platforms, we may collect information or employ third-party plug-ins that notify us about the device used to access our Digital Platforms. This information includes device model, operating system, software, preferences, advertising identifiers, mobile network information and applications installed on the device. The information thus collected may be disclosed to improve the User experience and service functionality.
  • Registered account details: Account information including your name, address, location, phone number, email address and other details that you may provide us with when you register yourself through any of our Digital Platforms.
  • Search results and preferences: Your Search results and optimization, traffic data, duration of usage of our Digital Platforms, features and ads clicked on, preferences and settings such as and cookie preferences and language preference.
  • Location details: Our Digital Platforms may access real-time information regarding the location of your device, if permitted by you.
  • Social media interactions: We may present you with the opportunity to interact with our content on third-party social networking websites and applications. When you do so, either through our opportunity or on your own volition, those third-party sites or applications will collect, use, or disclose information to enable your interaction with our content and as described in their privacy policies. We may also collect, use, and disclose certain information provided through those websites and applications to respond to your outreach, analyse your interactions with our content, and maintain our social media presence.

Accuracy of Information

You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of account registration with us directly or through our Digital Platforms. If your information changes or if the information provided is incorrect, you may correct, delete in accuracies, or amend information by making the change on your profile information and other pages on the Digital Platforms or by contacting us at info@zerothlogix.com or reaching out to us through contacts us page on https://www.zerothlogix.com/contactus. We will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable.

If you provide any information that is untrue, inaccurate, out of date or incomplete (or becomes untrue, inaccurate, out of date or incomplete), or the Company has reasonable grounds to suspect that the information provided by you is untrue, inaccurate, outdated or incomplete, the Company may, at its sole discretion, discontinue the provision of the Services to you.

If you wish to cancel your account or request that we no longer use your information, contact us through info@zerothlogix.com. We will retain your information for as long as your account is active and is needed to procure services from you or provide you the Services or is required under law. We shall not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force. After a period of time, your data may be anonymized and aggregated and then may be held by us or our Partners as long as necessary for us to provide  or improve our Services or Digital Platforms, but our use of the anonymized data will be solely for research, development, statistical analysis and business intelligence purposes.

Payment Details

The User may pay to the Company directly or through its Digital Platforms using a credit card, debit card, net banking or other online or offline payment mechanisms for availing Services/Digital Platforms. The User may provide the bank details and other financial information to the Company for receiving payment in relation to the contractual arrangement. The Company will collect such financial information of the User and will use that information for the billing and payment processes, including but not limited to the use and disclosure of such financial information to third parties or collected directly by the third parties as may be necessary to complete such billing operation as per applicable laws. Verification of such information, however, is accomplished solely by the User through the authentication process offered by banks, third-party payment gateways or financial institutions. User’s credit-card/debit card details are transacted upon secure sites of approved payment gateways which are digitally under encryption, thereby providing the highest possible degree of care as per current technology by the banks, third-party payment gateways or financial institutions. User is advised, however, that internet technology is not full proof safe and User should exercise discretion on using the same.

Cookies

Due to the communications standards on the Internet, when a User or anyone who visits the Digital Platforms, we automatically receive the URL of the site from which anyone visits. We also receive the Internet Protocol (IP) address of each User’s computer/device (or the proxy server a User used to access the World Wide Web), User’s computer/ device operating system and type of web browser the User is using, email patterns, as well as the name of User’s ISP. This information is used to analyse overall trends to help the Company improve its Services or Digital Platforms. The linkage between User’s IP address and User’s personally identifiable information may be available to us or our Partners but is not shared with other third parties. Notwithstanding the above, we may share some of the aggregate findings (not the specific data) in anonymized form (i.e., non-personally identifiable) with advertisers, sponsors, investors, strategic partners, and others to help grow our business.

A cookie is a small file placed on the hard drive of your device. Our Digital Platforms may use cookies to store certain data (that is not sensitive personal data or information) used by us and our Partners for the technical administration of the Digital Platforms, research and development, and for User administration. In the course of serving advertisements or optimising services to its Users, the Company may allow authorised third parties to place or recognise a unique cookie on the User’s browser. The cookies, however, do not store any information of the User.

In order to have access to all the features and benefits on our Digital Platforms, a User must first create an account on our Digital Platforms. To create an account, a User is required to provide the following information, which such User recognises and expressly acknowledges to be information, allowing others, including the Company and its Partners to identify the User’s name, User ID, email address, address, location, date of birth, gender, phone number, password and location chosen by the User. Other optional information may be requested on the registration page. We may, in future, include other optional requests for information from the User to help us customise the Services/Digital Platforms to deliver personalised information to the User. By affirming your assent to this Privacy Policy, or by accessing the Digital Platforms, or by using the Services or being the User in any manner whatsoever or by otherwise giving us your information or data or completing the registration process, you provide your consent as required under applicable law to our collection, use, storing, sharing, disclosing, transferring and otherwise dealing of your information as described in this Privacy Policy.

Some of our content or Digital Platforms may be served by third parties, including servers, content providers and application providers. This Privacy Policy applies to the Services provided by the Company and the Digital Platforms that are owned and operated by the Company. We do not exercise control over the third-party sites/apps that may be displayed, if any, as search results or links from within the Services/Digital Platforms. These other sites may place their own cookies or other files on the Users’ computer, collect data or solicit information from the Users, for which the Company is not responsible or liable.

Accordingly, the Company does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites/apps, nor does the Company guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such websites/apps. These third-party websites may place their own cookies, collect data, or solicit information independently. The Company does not control and is not responsible for the privacy practices, data collection policies, or content of such third-party sites. The inclusion or exclusion does not imply any endorsement by the Company of the website/app, the website/app’s provider, or the information on the website/app. If you choose/decide to visit a third-party website/app linked to the Digital Platforms, you do this entirely at your own risk. The Company encourages the User to read the privacy policies of that website/app.

Prohibited Activities

The Services/Digital Platforms may enable a User to communicate with other Users or to post information on the Digital Platforms which may be visible or accessed by others. Such Users, including any moderators or administrators, are not authorised by the Company representatives or agents, and their opinions or statements do not necessarily reflect those of the Company. They are not authorised in any manner to implicitly bind the Company to any contract. The Company hereby expressly disclaims any liability for any reliance or misuse of such information that is made available by Users or visitors in such a manner.

You agree not to host, share or publish any content that:

– belongs to another person without permission;

– is defamatory, obscene, pornographic, or violates others’ privacy;

– is misleading, false, or promotes illegal activity;

– infringes intellectual property rights;

– threatens national security or public order;

– spreads malware or causes technical harm;

– violates any applicable indian laws.

Other Conditions

If you are using the Digital Platforms, with your permission, we will use the geolocation feature of your device, or similar features of the device you are using to access the Digital Platforms. When you download and/or use the Digital Platforms, we automatically collect information on the type of device you use, operating system version, and the device identifier. The Company and our Partners do not share your location information with any third party except for the purposes of providing the Services. You may opt out of location-based services on your mobile phone by changing the relevant/ applicable setting at your device level.

We may process your information for the purposes related to safeguarding ourselves from loss or liability, such as the prevention of corporate espionage, maintenance of confidentiality of trade secrets, intellectual property, classified information or provision of any service or benefit sought by an employee.

The Company does not collect information about the visitors of the Digital Platforms from other sources, such as public records or bodies, or private organisations, save and except for the purposes of registration of the Users (the collection, storage and disclosure of which each User must agree to under the Terms of Use for the Company to effectively render the Services).

Sharing of Information

The Company may disclose your information in the following ways:

  1. Disclosure to Government authorities or as required by law

The Company may share your information with Government and/or statutory authorities in response to court orders, or other legal process; to establish or exercise legal rights; to ensure compliance with the law; to defend against legal claims; or for the purpose of verification of identity, or the prevention, detection, investigation including cyber incidents, or for prosecution and punishment of offences, as otherwise required by law. The Company warrants that (i) such information will be disclosed only in accordance with applicable laws and regulations; (ii) such disclosure is made in good faith and belief that it is reasonably necessary for enforcing the Policy.

b. Disclosure to Acquirers

The Company may disclose and/or transfer your information to an acquirer, assignee or other successor entity situated within or outside India in connection with a investment, sale, merger, or reorganisation of all or substantially all of the equity, business or assets of the Company. Confidentiality and Security

The Company has implemented best market practices and security policies, rules and technical measures to protect the personal data that it has under its control from unauthorised access, improper use or disclosure, unauthorised modification and unlawful destruction or accidental loss. However, for any data loss or theft due to unauthorised access to the User’s electronic devices through which the User avails the Services or accesses the Digital Platforms, the Company or its Partners shall not be held liable for any loss whatsoever incurred by the User.

The Company ensures that it and its partners implement reasonable security practices and procedures that are commensurate with respect to the information being collected and the nature of the Company’s business. The reasonable security practices and procedures implemented by us include, but are not limited to, encrypting data when it is on the move using industry standard practices, regularly changing production keys and passwords, secure access to all production servers, performing regular security updates on our servers and more.

Your information is maintained by the Company in electronic form on its or its employees’ and Partners’ systems, servers or other digital platforms. Such information may also be converted to physical form from time to time. We take necessary precautions to protect your information both online and offline and implement reasonable security practices and measures, including certain managerial, technical, operational and physical security control measures that are commensurate with respect to the information being collected and the nature of the Company’s business.

No administrator at the Company will have knowledge of your password. It is important for you to protect against unauthorised access to your password, your computer and your mobile phone or device. Be sure to log off from the Digital Platforms when finished. The Company and its Partners do not undertake any liability for any unauthorised use of your account and password. You hereby agree to indemnify the Company, its employees and Partners for any loss suffered by them due to such unauthorised use of your account and password.

The Company makes all User information accessible to its employees only on a need-to-know basis.
